Report material that infringes your copyright.
How to tell us that something shared through Base infringes your copyright, how a person can respond, and what we do with each.
1. Before you send a notice
Base hosts documents that its customers upload and share. A Base shared by link can be read by anyone who has the link, and some are listed publicly; an invite-only Base can be read only by the people invited. If you believe material reachable through Base infringes a copyright you own or are authorized to act for, send us a notice as described below. We act on notices about material we host; we cannot act on copies held elsewhere.
2. What a notice must include
Under the U.S. Digital Millennium Copyright Act, a notice must be in writing and include:
- Your physical or electronic signature, as the owner or as a person authorized to act for the owner.
- Identification of the copyrighted work you say is infringed, or a representative list if there are several.
- Identification of the material you say infringes, with enough detail for us to find it, such as the share link and the document name or page.
- Your name, postal address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner.
A notice that misrepresents that material infringes can make the sender liable for damages. If you are unsure whether a use is infringing, for example because it may be fair use, consider getting legal advice first.
3. Where to send it
Email notices to legal@luckytreelabs.com with “Copyright notice” in the subject, or mail them to the designated agent below.
Designated agent
Copyright Agent, Lucky Tree Labs, LLC. Email: legal@luckytreelabs.com. Our registration with the U.S. Copyright Office’s directory of designated agents, with the agent’s postal address, will be listed here once it is complete.
4. What we do with a notice
When we receive a complete notice, we remove or disable access to the material, tell the owner of the Base that we did and why, and give them a copy of the notice with your contact details, as the law expects. We may contact you if a notice is incomplete. We keep a record of each notice and what we decided.
5. Counter-notices
If material you uploaded was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the same address. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Lucky Tree Labs, LLC may be found), and that you will accept service of process from the person who sent the notice or their agent.
We send a valid counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we restore the material within 10 to 14 business days of receiving the counter-notice.
6. Repeat infringers
We close, in appropriate circumstances, the accounts of people who are the subject of repeated valid notices.
